By purchasing or using Apex WOD Builder you agree to these terms. Please read them. They're written in plain English.
1. About the Product
Apex WOD Builder ("the App") is a Progressive Web Application (PWA) for workout programming and performance tracking. It is sold as a lifetime software licence — a one-time purchase of USD $29 granting permanent access to the app and all future updates.
The App is operated by Apex WOD App, an Australian sole trader, trading as Apex WOD Builder ("we", "us", "our").
2. Licence
Upon completing your purchase you are granted a personal, non-exclusive, non-transferable, worldwide licence to use Apex WOD Builder for your own personal or commercial fitness programming purposes.
You may not:
- Resell, sublicence, or redistribute the App or any part of it
- Reverse engineer, decompile, or attempt to extract source code
- Use the App to build a competing product
- Share your licence credentials with others
3. Free Trial
The App offers a free trial permitting up to three (3) logged workout sessions. No payment or account creation is required to access the trial. After three sessions, continued use requires purchase of the lifetime licence. Trial session data is preserved and migrated upon purchase.
4. Payment & Pricing
The lifetime licence is priced at USD $29.00 as a one-time payment. Prices are displayed and charged in US Dollars. Your bank or card provider may apply currency conversion fees — this is outside our control.
Payment is processed securely by Stripe, Inc. We do not store your payment details. A purchase confirmation will be sent to the email address you provide at checkout.
5. Updates & Availability
Your lifetime licence includes all future updates to the App at no additional cost. We commit to maintaining the App in working condition. However, we do not guarantee uninterrupted availability and reserve the right to modify, update, or discontinue features with reasonable notice.
In the unlikely event the App is discontinued, we will provide at least 90 days notice.
6. User Responsibilities
Apex WOD Builder is a programming and tracking tool. It does not provide medical advice. You are solely responsible for:
- Ensuring the suitability of any workout programme for your physical condition
- Consulting a qualified health professional before beginning any new exercise programme
- Any injury, loss, or damage arising from use of the App or its programming suggestions
7. Data & Exports
Your workout data is stored locally on your device. We do not back up your data on our servers. You are responsible for maintaining your own backups. The App provides JSON and CSV export functionality for this purpose.
8. Limitation of Liability
To the maximum extent permitted by Australian law, our total liability to you for any claim arising out of or in connection with these terms or the App shall not exceed the amount you paid for your licence (USD $29.00).
We are not liable for indirect, incidental, special, or consequential damages including loss of data, loss of revenue, or personal injury.
9. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
10. Governing Law
These terms are governed by the laws of the State of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, without prejudice to any mandatory consumer protection rights you hold in your own jurisdiction.
